Why cant they be stopped?

Ok just for the record i wasnt sure where to put this. So i put it in software becuse it kinda is software..
Ok now to get started
I was looking on Download.com becuse i like to see all the shiny new programs and such and sometimes i pick up some myself. I look at the program lists and say "PC Started Kit" just to see whats there ( i did find a nifty program there) So i fumbled through there programs till i saw a what i thought was a ad. But it said "Dirty Dialer" and it was on their site. It was a virus horror story, So they were kinda intresting. But more more then half of them where about a trojan that i had MUCH experince with. It goes into the tool bar and "Acts" like its a windows warning, it says something like "You computer has (Some random virues/Worm/trojan) Click here to get protection" yada yada.. I've seen this trojan in many forms but its all the same.
So i was thinking "isnt this crap illegal" Shouldent the makers or distabutors of this trojan be sued or something. Last time i looked Programs that acted Maliciously could be punished by law (i think). I've delt with this trojan many times(my step sister thinks everytime smilys and such are free and they say "Spyware Free" that they are) So i deal with this trojan and a "Every-other-weekly" basis. I lost the link to the stories, but when i find it i will be sure to post it.
I've seen this trojan on ALOT of sites, manly. Keygen,porn,joke(sometimes),illegal download site(or so they say), and p2p programs.
Just thought i'd bring this to attention, and see what people have to say.
(Put this in the right part of the forum if you think i put it in the wrong one.)

EDIT:
I would also like to add, the programs, self download and self install. Which is kinda weird that they self install. Even if you do Ctrl-Alt-Del and shut them down, they come back with more.

Software thats in the Spyware/Malware category usually isnt illegal. If something pops up and says "Click here to get rid of XXXX" usually means you have malware installed and they try and sell you their sh*t to get rid of the sh*t that they put on there in the first place. This SHOULD be illegal and most of it probably is in the US anyways, but you have the problem of different laws in different countries. If the server that hosts that garbage is located outside US territory all laws go down the drain.

Needless to say this sh*t shouldnt be on Download.com. That being said, I'm sure some of those software packages are probably legit Apps, just their terrorist-like marketing techniques are not, in the least bit, ethical.....

10+ Years of f*ckin with computers and I pretty know what to avoid and how to lock my box down to avoid this sh*t. Not using IE helps a lot........

Download.com wasnt hosting bad apps. They had to horror stories.
I was thumbing through them.
I think that deleting the registry keys to AV's therfor make them usless, and being unstopable should be illgal. and running in safe mode making it next to impossible to remove it. Thats my story, but how i got it was a diffrent story. Which i wont tell unless people wanna hear it :9: . But i think people using P2P programs that get Viruses and ect... deserve it for being ignorant and not checking the file size and using a p2p program.
